Hosting terms

The plain-English terms for building, hosting and looking after your site.

These are the terms between you (the client) and THATCOOLWEBSITE (Spencer Ayres, trading as THATCOOLWEBSITE) for building and hosting your website. They are written to be read, not to catch you out. If anything is unclear, ask before you agree.

1. The offer

  • Build: £600. £300 when you accept the preview, £300 when the site goes live.
  • Hosting: £25 a month, starting at go-live. Cancel any time. No notice period.
  • Instalment option, on request: £75 a month for 12 months, then £25 a month. This is the £600 build spread over 12 payments plus hosting. Interest-free. There is no premium for paying this way and no longer term.
  • Domain: registered or managed by us, in your name as legal registrant, and recharged to you at cost on the next invoice.

2. What's included

A single-page website built for your business, mobile-first, with a contact form, Google Maps, your Instagram feed, three rounds of amends before go-live, hosting, SSL, and small updates after go-live (opening hours, prices, a supplied photo, a typo, a list item).

Not included: copywriting, photography, extra pages, new sections, redesigns, integrations and online shops. These are quoted before work starts. Amends after the third round before go-live are quoted at £75 a batch.

3. Ownership

Until the build is paid in full, the site (design, code and files) belongs to THATCOOLWEBSITE. Once the build is paid in full, it belongs to you. Your own words, photos, logo and brand were always yours.

Your domain name is registered in your name. You can transfer it away at any time.

4. Cancelling hosting

You can cancel hosting whenever you like by emailing us.

If the build is paid in full: we send you a zip of your site files within 14 days, keep the site online for 30 days from your notice so you can move it, then take it down and close the hosting. We transfer the domain to you on request.

If the build is not paid in full (instalment clients before payment 12): the site comes down when hosting ends and no files are handed over, because the site is not yet yours. You can settle the outstanding build balance at any time to take ownership.

5. Missed payments

If a payment fails we send a plain reminder at 7 days and a second at 14 days. At 30 days the site is replaced with a holding page until the payment is made, then restored. We do not charge late fees.

6. What we look after

We keep the site online, secure and backed up, keep the Instagram feed current, and make small updates you log on your amends sheet. We aim to action basic updates within two working days.

We do not promise a Google ranking, a number of visitors or a number of enquiries. We do build the site so search engines can read it properly.

7. Your responsibilities

You confirm you have the right to use the words, photos, logos and other material you give us. You keep your contact details with us current so invoices and reminders reach you.

8. Liability

We take care, but we are a small business and this is a small website. Our total liability to you under these terms is limited to the amount you have paid us in the previous 12 months. We are not liable for loss of business, profit or data arising from the site being unavailable, except where the law says we cannot exclude it.

9. Changes

We may update these terms. If the change affects you materially, we email you 30 days before it takes effect. You can cancel if you do not agree.

10. Law

These terms are governed by the law of England and Wales.
